SheSafe Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SheSafe mobile application, SheSafe pages at boonts.com, invitation links, and related support services (collectively, the "Service"). By creating an account, affirmatively accepting these Terms, or using the Service, you agree to these Terms and acknowledge the SheSafe Privacy Policy.

SheSafe is operated by Roman Babunts, the individual App Store seller identified as the app provider on the applicable SheSafe App Store product page (the "SheSafe operator"). "SheSafe", "we", "us", and "our" mean that operator.

If you do not agree, do not access or use the Service.

1. Service Scope

SheSafe is a personal safety coordination tool for adults. Depending on release, device, permissions, region, and configuration, the Service may provide:

• user-started journeys and Date Mode sessions;
• temporary live or last-known location, route, destination, venue, ETA, status, battery, sound, and connectivity sharing with invited trusted contacts;
• scheduled local check-ins and reminders;
• automatic escalation after a missed check-in or extended connection loss;
• manual, hold-and-release, timeout, and duress SOS workflows;
• PII-minimized push handoffs and trusted-contact acknowledgements;
• widgets, deep links, join codes, and system share-sheet actions;
• country-based emergency-number prompts;
• community incident reports and confirmations, street-lighting information, travel advisories, and local safety scores; and
• account, support, privacy, and deletion controls.

Features may differ from descriptions, screenshots, prototypes, website copy, or a product requirements document. The behavior of the release actually installed on your device and the applicable in-app disclosures controls.

2. Eligibility, Accounts, And Permissions

You must be at least 18 years old, legally capable of entering into these Terms, and permitted to use the Service under applicable law. You may not use the Service if we previously suspended you or if using it would violate applicable trade, sanctions, export-control, or other law.

You must provide accurate information, keep it reasonably current, and maintain control of your device, sign-in methods, session, and credentials. You are responsible for activity through your account except to the extent caused by our breach of a non-waivable duty.

Some features require location, background location, notification, network, and device permissions. You may decline or revoke a permission, but the affected feature may be unavailable, delayed, or unreliable. Never alter device settings in a way that creates danger to you or another person.

3. Critical Safety And Emergency Disclaimer

In an immediate emergency, call the appropriate local emergency number first if you can do so safely. Do not wait for SheSafe, a notification, a safety score, or a trusted contact.

No person at SheSafe continuously monitors journeys, SOS events, messages, or incident reports. The Service does not automatically dispatch police, ambulance, fire, or other public responders. A trusted contact has no duty under these Terms to monitor, respond, call, travel, intervene, or obtain help, and we do not control their actions.

You must maintain an independent safety plan, use judgment appropriate to the circumstances, and test non-emergency functionality before relying on it. Do not use the Service as your only or primary means of protection or communication.

4. Technical Limitations And Assumption Of Risk

Alerts, calls, notifications, check-ins, location, deep links, widgets, scores, and SOS events may be late, duplicated, inaccurate, degraded, blocked, or never delivered, received, displayed, heard, opened, or acted upon. The Service depends on hardware, battery, GPS, operating systems, app state, permissions, background-execution limits, Focus/Do Not Disturb settings, push providers, internet and cellular coverage, carriers, maps, app stores, third-party services, and a recipient's device and attention.

Background location may be suspended, delayed, or throttled even after you grant permission. "Time Sensitive" or "High Priority" does not guarantee a Do Not Disturb bypass, sound, display, or delivery. A last-known location can identify the device rather than the user and may be stale or wrong.

To the fullest extent permitted by law, you knowingly accept the inherent risks of using an experimental personal safety coordination tool and remain responsible for decisions about your route, meeting, response, and personal safety. Nothing in these Terms requires you to take an unsafe action.

5. Check-Ins, Automatic Escalation, SOS, And PINs

Depending on the selected mode and current configuration:

• routine prompts may be scheduled locally on the primary user's device;
• ignoring a check-in, selecting "Need Help", releasing an armed control, entering a duress flow, or losing connectivity for a configured period may automatically create an SOS or disconnected event;
• an event may share a last-known location and status with trusted contacts;
• queued events may be transmitted later when connectivity returns, even if the triggering circumstances have changed; and
• a journey may automatically expire after an operational timeout. Automatic expiry means only that the Service stopped treating the journey as active; it is not confirmation that the user arrived or is safe.

False positives and missed alerts are possible. Use a manual cancel or resolution control when it is safe and appropriate, and independently contact your trusted contacts if an alert was sent accidentally.

The cancel PIN is a convenience control, not a bank-grade credential or a guarantee against coercion, guessing, shoulder surfing, device compromise, or data loss. A duress PIN or visually concealed flow may fail to remain secret or to transmit an alert. Do not reuse an important PIN. You are responsible for remembering and protecting it.

6. Emergency Numbers, Maps, And Safety Information

Emergency numbers are selected from a country mapping and may be unavailable, outdated, or wrong for your actual location, carrier, language, or emergency. The Service may prefill a number but does not guarantee a completed call or the identity, jurisdiction, availability, or response of the recipient. Verify local numbers independently when practical.

Maps, routes, incident markers, street-lighting labels, travel advisories, and safety scores come from users, public datasets, heuristics, and third parties. They may be estimated, incomplete, stale, duplicated, unavailable, or incorrect. A label such as "verified", "lit", "safe", "moderate", or "risk" is not a finding by SheSafe, police, a government agency, or a safety professional and does not establish that an incident occurred or that a place is safe or dangerous.

The Service does not currently provide a professionally validated safe-route recommendation. Do not use a score, marker, absence of reports, or lighting data as the sole basis for travel or emergency decisions.

7. Trusted Contacts, Invitations, And Consent

Add or invite only people you know and are legally allowed to contact. Do not enroll another person, share their location, or create a monitoring relationship without their knowledge and valid permission. An invitation is not proof of identity, authority, relationship, or willingness to respond.

You are responsible for reviewing your connected contacts and ending a journey or removing access when sharing is no longer wanted. Information already viewed, copied, screenshotted, exported, or forwarded by a recipient may remain outside our control.

If you receive another person's information, you may use it only for the consensual safety purpose for which it was shared. You must not use it to stalk, coerce, control, discriminate, retaliate, embarrass, publish, sell, advertise, or infer unrelated sensitive facts about that person.

8. Community Reports And User Content

Community incident reports and confirmations are user-generated content. They are provided for general awareness and may not be accurate. A verification count reflects user actions, not independent investigation. Do not submit an incident report instead of contacting emergency services or law enforcement when official reporting is appropriate.

You must not include a person's name, image, contact details, home address, license plate, or other identifying information; accuse an identifiable person of a crime; reveal victim or witness information; encourage vigilantism; or post content that is false, fabricated, defamatory, threatening, discriminatory, graphic, sexually exploitative, privacy-invasive, or unlawful.

You retain ownership of content you submit. You grant SheSafe a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, format, translate, transmit, display, moderate, remove, and otherwise process it only as reasonably needed to provide, secure, improve, and promote the relevant Service feature, comply with law, and enforce these Terms. For public incident content, this license lasts while the report remains published; backup, legal, security, and de-identified copies may survive as permitted by law.

You represent that you have the rights and permissions necessary to submit the content. We may, but are not obligated to, review, label, restrict, preserve, or remove content. Report objectionable content, abuse, or a safety concern to [email protected]. Moderation does not make us the author or guarantor of user content.

9. Acceptable Use

You must not:

• secretly track, pressure, threaten, harass, surveil, or control another person;
• trigger false SOS events, emergency calls, reports, or notifications, except for clearly disclosed and safe testing that does not burden others;
• impersonate anyone or misrepresent an incident, identity, relationship, permission, location, or verification;
• access another account, event, location, invite, or data without authorization;
• publish private safety information or use it for employment, insurance, housing, credit, eligibility, law-enforcement profiling, or other unrelated decisions;
• scrape, crawl, bulk export, reverse engineer, probe, disable, bypass, or interfere with the Service or its security, rate limits, access controls, or intellectual property, except where law expressly permits;
• upload malicious code, spam, or content that violates law or another person's rights; or
• use the Service commercially, resell it, dispatch third parties through it, or represent that you are affiliated with SheSafe without written permission.

We may rate-limit, restrict, preserve evidence, suspend, or terminate access if we reasonably believe use violates these Terms, creates safety or legal risk, or threatens a user, provider, SheSafe, or the public.

10. License And Intellectual Property

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to use the installed app and Service for lawful, non-commercial purposes on devices you own or control and as permitted by applicable app-store usage rules.

The Service, software, design, brand, logos, documentation, and non-user content are owned by SheSafe or its licensors and protected by applicable laws. Public map and advisory data may be subject to separate attribution and license terms. No rights are granted except as expressly stated.

If you provide feedback, you grant us a perpetual, worldwide, irrevocable, royalty-free right to use it without restriction or compensation, without identifying you publicly unless you agree.

11. Notifications And Communications

You may receive local notifications, push notifications, in-app messages, safety alerts, account and security notices, legal notices, and support replies. Carrier, SMS, internet, roaming, or device charges may apply. Service messages are not marketing merely because they are urgent or transactional.

You can manage permissions in device settings, but disabling them can make features unavailable or unreliable. We do not promise an individual email or push notification for every legal-document update; Section 19 explains when posting, additional notice, or consent applies.

12. Third-Party Services And Terms

The Service relies on app stores, operating systems, Supabase, Apple and Google authentication and push services, MapLibre, OpenFreeMap, OpenStreetMap/Overpass, public advisory sources, Apple App Store Connect Analytics, Google Play Console, Google Analytics for Firebase where the user opts in, Umami and other website analytics providers, Cloudflare, GitHub Pages, email providers, networks, carriers, and other third parties.

Their terms, privacy practices, licenses, outages, restrictions, and fees may apply. You must comply with applicable third-party terms, including app-store and carrier/data-plan terms. We do not control or endorse third-party content or services and are not responsible for their acts or omissions to the fullest extent permitted by law.

13. Availability, Beta Features, And Service Changes

The Service may contain experimental, beta, simulated, fallback, or configuration-dependent features. We do not promise a release date, geographic coverage, feature parity, data source, minimum uptime, retention of a feature, or compatibility with every device.

We may add, modify, limit, suspend, or discontinue a feature, provider, dataset, region, account, or the Service at any time. We may act without advance notice for security, abuse, legal, provider, operational, or safety reasons. Where law requires advance notice or a remedy, we will provide it.

14. Account Deletion, Suspension, And Termination

You may request account deletion through the app or [email protected]. Local uninstall does not by itself delete server data. Deletion and retention are described in the Privacy Policy and may be limited by security, fraud prevention, legal compliance, disputes, backup integrity, public content, or another user's legitimate records.

We may suspend or terminate an account immediately if we reasonably believe the user violated these Terms, created risk, abused a safety feature, or used the Service unlawfully. We may discontinue the Service, subject to mandatory rights. Upon termination, the license ends, but provisions that by nature should survive remain effective, including ownership, content licenses, disclaimers, limitations, disputes, and accrued rights.

15. No Warranties

To the fullest extent permitted by applicable law, the Service and all maps, scores, reports, advisories, notifications, and content are provided "as is" and "as available" without express, implied, or statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, quiet enjoyment, reliability, or uninterrupted operation.

We do not warrant that the Service will prevent harm; detect an emergency; operate in the background; preserve secrecy; identify the correct location, number, risk, or person; deliver an alert; or cause anyone to respond.

Some jurisdictions do not permit certain exclusions, so those exclusions apply only to the extent permitted.

16. Limitation Of Liability

To the fullest extent permitted by law, SheSafe and its operator, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, opportunity, goodwill, expected safety outcome, or business interruption, arising from or related to the Service.

To the fullest extent permitted by law, this includes claims arising from crime, harassment, assault, injury, death, emotional distress, property loss; a missed, late, false, or inaccurate alert; stale or wrong location or safety information; failure of a device, network, provider, trusted contact, or emergency service; unauthorized recipient conduct; or inability to access the Service.

Our aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid directly for the Service during the 12 months before the event giving rise to the claim or (b) USD 100.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where such limitation is prohibited, or any statutory, privacy, product-liability, or consumer right that cannot lawfully be waived. The exclusions and cap apply only to the maximum extent allowed in your jurisdiction.

17. Indemnity

To the extent permitted by law, you will indemnify and hold harmless SheSafe and its operator, affiliates, licensors, and service providers from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful or unauthorized use, your content, your infringement of another person's rights, or your material breach of these Terms. This obligation does not apply to the extent a claim results from our own breach or conduct and does not override non-waivable consumer rights.

18. Governing Law And Disputes

Contact [email protected] first so we can try to resolve a dispute informally. This does not prevent either party from seeking urgent relief or using a statutory complaint or consumer-resolution process.

Except where mandatory law provides otherwise, these Terms and non-contractual disputes are governed by the laws of the Republic of Serbia, without regard to conflict-of-law principles, and the competent courts in Belgrade, Serbia have exclusive jurisdiction. If you are a consumer, you retain any mandatory rights and forum protections of your country of residence.

Nothing in these Terms requires individual arbitration, waives a class or representative procedure, shortens a mandatory limitation period, or removes a right that applicable law makes non-waivable.

19. Changes To These Terms

We may update these Terms as the Service, providers, law, or risk profile changes. The posted "Last updated" date identifies the current version. Posting revised Terms on the Service is our primary publication method, and we do not undertake to send individual notice for every editorial, clarifying, non-substantive, or user-beneficial change. Such changes may take effect when posted.

For a material prospective change, we may set a later effective date and provide an in-app, email, prominent, or other notice, and obtain fresh acceptance or consent, only where the nature of the change, applicable law, or platform policy requires it. Continued use after the effective date constitutes acceptance to the extent permitted by law. If you do not agree, stop using the Service and request account deletion. We will not impose a materially adverse retroactive change where prohibited.

20. App-Store Terms

If you obtained the app from Apple, you and SheSafe acknowledge that these Terms are between you and SheSafe, not Apple; SheSafe, not Apple, is responsible for the app, support, warranties, product claims, and intellectual-property claims to the extent required by applicable law. The license is limited to Apple-branded products you own or control as permitted by the Apple Media Services usage rules, including applicable Family Sharing or similar rules. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it. Nothing here conflicts with mandatory Apple usage rules.

If you obtained the app from Google Play or another distributor, its applicable terms also apply. The distributor is not responsible for the Service except as its mandatory terms or law expressly provide.

21. General Terms

These Terms and the documents expressly incorporated into them are the entire agreement about the Service and supersede prior Service terms. If a provision is unenforceable, it will be modified only as needed or severed, and the remaining provisions continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or asset transfer, subject to law.
